New Mexico "Blue Sky" LawsThe United States Securities and Exchange Commission (SEC) regulates and enforces the securities laws at the federal level. It seeks to protect investors and encourage capital formation, and to accomplish this objective, it oversees the key participants in the securities industry and requires public companies to disclose particular information to the public.
At the local level, each state has its own securities laws, known as "Blue Sky" laws, and in New Mexico, this law is known as the New Mexico Securities Act. The New Mexico Securities Division (the "Division") regulates broker-dealers, investment advisors, and registered representatives and it can deny, suspend, or revoke these licenses if there is a violation of state or federal securities laws. The Division also investigates alleged violations of the securities laws and can bring criminal and civil actions against individuals and firms. Moreover, the Division dedicates numerous resources towards investor education to protect consumers from investment fraud.
